Visto de turista enquanto espera o processo.

Muita gente me pergunta se eu não posso tirar o visto de turista enquanto espero esse longo processo. Eu pesquisei bastante na internet e resolvi que não vou arriscar.  Os motivos são:
1) Taxa de 131 dolares + taxa de agendamento
2) Probabilidade enorme de negar
3) Aparecer no sistema do Consulado com o visto negado americano


Eu contactei um consul, o consulado americano de Recife e do Rio de Janeiro. Eis a minha pergunta.

Good afternoon,

I am interested in applying for a tourist visa; however, my situation is unique. Can you advise me about my chances of receiving a tourist visa? The details of my situation are as follows:

I am a Brazilian citizen and my fiancée is a U.S. citizen. We applied for the k-1 visa in January. My fiancée has already come to Brazil two times. He is a medical student at the University of Kentucky and he’s doing research in the biochemistry department. I am a veterinarian and I am working for a multinational company in Brazil. I’ve been to the United States two times and I have also traveled to countries in Europe.

I want to visit him while our k-1 application is being processed, because due to studies and work, he is unable to visit me for some time. I would like to know the chances of receiving a tourist visa while I am still in process for a k-1 visa.

I have documents (purchase of a buffet, music, decorations, invitations) from my unofficial wedding to be held in Brazil in September (for family and guests that can not attend the wedding in the U.S.) that show I plan to return to Brazil. I can guarantee that I will return to Brazil because I want to immigrate legally at a later time using the k-1 visa.

Dear Ms. Maravilha,

Thank you for the information, you are welcome to apply for a visa in Recife. We also inform that, in order to be approved for a visa, applicants must satisfy the interviewing officer that they are entitled to the type of visa for which they are applying according to the U.S. Immigration Law. This means that before a visa can be issued, applicants must demonstrate strong social, economic and/or familial ties outside the United States.

"The burden of proof lies on the applicant him/herself.  While information regarding financial support, invitations, or motives for trips provided by friends or family in the United States is taken into considered, ultimately, applicants must qualify on their own merit."

To apply, you must submit an application form and recent photo, pay the visa application fee schedule an appointment through the website www.visto-eua.com.br or through the Call Center at 55-21-4004-4950.  You may schedule your appointment at any post in Brazil (Recife, São Paulo, Rio de Janeiro or Brasília).  Please be aware that there is no guarantee that a visa will be issued, only the result of an interview can decide so.

Prezada sra. Maravilha,

É extremamente recomendavel que pessoas aguardando a conclusao de processos de vistos de imigrantes aguardem em seus países de origem. Se ainda assim desejar solicitar um visto de turismo, a sra. deve seguir todos os procedimentos normais listados nos sites www.embaixadaamericana.org.br e www.visto-eua.com.br. Observe, entretanto, que vistos de turismo so podem ser concedidos a pessoas que nao tenham interesse de imigrar para os EUA em nenhum momento.  Ou seja, o fato de possuir um processo paralelo para visto de imigrante podera dificultar a aprovacao de sua solicitacao de um visto de turismo.

Duvidas sobre vistos de turismo devem ser enviadas somente para nosso setor de vistos temporarios: visario@state.gov.

Conclusão fica dificil...

Por um lado, o Consulado de Recife foi otimista se mostrar laços sociais, econômicos que me prendem ao Brasil.
Já o Consulado do Rio recomenda que não entre em processo de visto de turista enquanto aguarda imigração.


Mas sabe, já estamos em 3 meses de processo... Eu prefiro não arriscar.
